If you are being made redundant your employer may present you with a compromise agreement. This document sets out how much redundancy pay you are to receive together with the terms and conditions relating to you leaving their employment. You are required to seek independent legal advice before signing it and Gartons are here to ensure that you receive all that you are entitled to.

Q: What is a Compromise Agreement?

A: As an employee you have employment rights that you can give up in return for payment by your employer. For the Agreement to be binding, the employee must have independent legal advice from a qualified solicitor who may be referred to in the agreement as ‘relevant independent adviser’. Once signed the agreement is binding upon you

Q: Who pays for the advice and how much will it cost?

A: Your employer will normally make a contribution towards your costs of obtaining the required advice on the Compromise Agreement and, in most cases, this contribution will cover the costs.

If it is a complicated matter and the costs are likely to be more that your employers contribution we will let you know before any work is done on your behalf.

In 99 out of 100 cases the payment offered by your employer will cover our costs so you receive 100% of your redundancy payment.

Q: Are Gartons a ‘relevant independent advisor?’

A: Yes we are.

The advice you receive, in relation to your Compromise Agreements will be provided by a qualified Solicitor, regulated by the Solicitor’s Regulation Authority and, as such, is regarded as a "relevant independent advisor".

Q: Why do I need advice from someone else – can’t I just the sign the agreement?

A: No, sorry.

The law that covers Compromise Agreements states that you must receive independent legal advice, from a "relevant independent advisor", about the terms and effect of the proposed Compromise Agreement before signing it. If not, the agreement cannot be enforced by either party

Q: Do I need to come to your office?

A: No, we are able to provide a personal and professional service, in relation to your agreement by post so that you can deal with it in your free time and without taking up your time by visiting our office. You are of course more than welcome to visit us and have your matter dealt with face-to-face, it is entirely upto you.

Q: What if I don’t accept the terms of the agreement ?

A: If you are unhappy with the agreement you can either ask us to renegotiate the terms and or pursue the matter through the employment tribunal. We can help you prepare and lodge the paperwork and provide representation at the tribunal. Please contact us to discuss the matter further.
